Probate, or estate administration, is a court-supervised process for identifying and gathering the assets of a deceased person, paying their debts, and distributing the remaining assets to their beneficiaries. Probate may occur whether or not the deceased left a will.
Formal Administration
In a formal administration, the court oversees the process and appoints a personal representative for the estate. Once appointed, the court issues Letters of Administration colloquially known as Letters Testamentary, which give that person legal authority to act on behalf of the estate. These letters allow the representative to access assets, manage estate affairs, pay valid debts and taxes, and carry out the distribution of property to heirs or beneficiaries in accordance with the law or the terms of a will, if one exists.
Ancillary Administration
When a deceased individual owns real estate in multiple states, an estate must be opened in each state. The estate administration in the state where the Decedent was not a resident is often called an Ancillary Administration. Probate Courts only have jurisdiction for real property within their state borders. Many deceased individuals own investment properties, second homes, income properties, rental properties, or other real estate investments in Florida. Ancillary administrations will usually mirror other Florida estate administrations but also frequently requires additional documentation from the decedent’s home-state Court.
Summary Administration
Summary Administration is a type of proceeding that the firm receives a lot of inquiries about. Much of the material written online make it seem like any estate under a certain value threshold is the right fit for a Summary Administration. While Summary Administration proceedings are usually faster, they may have significant drawbacks. Sometimes banks and other financial institutions may not acknowledge Summary Administration court orders.
